WARRANTY

In accordance with current legislation, the warranty regime on products sold by TEC Store Italia varies depending on whether the purchaser is a Consumer Customer or a Professional Customer: in the former case, the legal warranty of conformity (hereinafter, "Legal Warranty") will apply pursuant to the Consumer Code; in the latter, the warranty for defects in the sold item governed by the Civil Code.

6.1 Professional Customer
The product purchased by a professional customer (i.e., a natural or legal person acting in the exercise of their business, commercial, craft or professional activity, or their intermediary) is covered by the warranty for defects in the sold item pursuant to articles 1490 et seq. of the Civil Code.

The action of the Professional Customer to enforce said warranty expires 1 year after the delivery of the purchased product, and any related defects must be reported within the terms set forth in article 1495 of the Civil Code.

6.2 Consumer Customer
The product purchased by the consumer customer is covered by the Legal Warranty for consumer goods as regulated by articles 128 et seq. of the Consumer Code and, to the extent not expressly provided therein, by articles 1490 et seq. of the Civil Code on sales contracts.

The Legal Warranty applies to and is borne by the seller if the product shows conformity defects, provided that such defects become apparent within 24 months from the date of delivery of the goods to the Customer and are reported by the latter within 2 months from the date of discovery of the defects, in accordance with article 132 of the Consumer Code.

A conformity defect exists when the product: (i) is not fit for the use for which goods of the same type are normally used; (ii) does not conform to the description or does not possess the qualities promised by the seller; (iii) does not offer the usual qualities and performance of goods of the same type; (iv) is not fit for the particular use intended by the consumer if made known to the seller at the time of purchase and accepted by the seller.

6.3 Remedies available to the Consumer Customer
Pursuant to art. 130 of the Consumer Code, in the presence of a conformity defect, the Customer may choose to request either the repair of the product or its replacement, unless the requested remedy is objectively impossible or excessively burdensome compared to the other according to the provisions of art. 130 paragraph 4 of the Consumer Code.

In particular, one of the two remedies is to be considered excessively burdensome if it imposes unreasonable costs on the seller compared to the other, taking into account: (i) the value that the goods would have if there were no conformity defect; (ii) the extent of the conformity defect; (iii) the possibility that the alternative remedy could be carried out without significant inconvenience for the Customer.

In order to provide a high-level and absolutely transparent after-sales service, TEC Store Italia undertakes, on a voluntary basis, to have the defective product repaired or replaced within a maximum period of 40 (forty) days from the warranty assistance request.

The Customer may also request, at their choice, a suitable price reduction or termination of the contract, if one of the following situations occurs: (i) repair or replacement is impossible or excessively burdensome; (ii) TEC Store Italia has not repaired or replaced the product within 40 (forty) days from the warranty assistance request; (iii) the previously performed replacement or repair has caused significant inconvenience to the Customer.

Upon receipt of the complaint of the conformity defect and provided that the reported defect exists and is technically ascertained, TEC Store Italia may offer the Customer any other available remedies with the following effects: (i) if the Customer has already requested a specific remedy, TEC Store Italia remains obliged to implement it with the necessary consequences regarding the start of the 40-day period mentioned above, unless the Customer accepts the proposed alternative remedy; (ii) if the Customer has not yet requested a specific remedy, they may accept the proposal or reject it by choosing another of the remedies provided by law.

In any case, a minor conformity defect for which it is not possible or is excessively burdensome to pursue the remedies of repair or replacement does not entitle the termination of the contract.

6.4 Cases of exclusion of the Legal Warranty
In accordance with the applicable provisions of the Consumer Code and the Civil Code, the Legal Warranty is excluded if one of the following hypotheses occurs: (i) the product has been repaired, tampered with, delivered for technical examination, or altered by persons other than the manufacturer, TEC Store Italia, or any other authorized entity (e.g., technical assistance centers not authorized by the manufacturer); (ii) the alleged conformity defect of the product became apparent after the 2-year period from the delivery of the product itself and/or the related request for repair or replacement of the defective product was sent after 2 months from the discovery of the defect; (iii) the alleged defect is due (in whole or in part) to improper and/or incorrect use/storage/maintenance or installation – by the Customer or by persons other than the manufacturer, TEC Store Italia, or any other authorized entity –/or is due to non-observance of the instructions provided by the manufacturer and present, for example, in the product user manual or other instructions provided by TEC Store Italia together with the delivered products; (iv) at the time of the conclusion of the contract, the Customer was aware of the defect and could not have ignored it with ordinary diligence; (v) the conformity defect derives from instructions or materials provided by the Customer.

6.5 How to activate the Legal Warranty
If the Customer has purchased the product with home delivery, the Legal Warranty must be enforced directly against TEC Store Italia using the following methods: (i) by phone, contacting one of the stores; (ii) via email or notification, by writing to info@tecstoreitalia.com ; (iii) online, by filling out the appropriate form available on the Website on the returns and warranties pages. The staff will provide the Customer with all necessary information regarding the conditions and procedures for exercising the Legal Warranty.

If the Customer has chosen to collect and purchase the product booked through the Website at a TEC Store Italia point of sale or an Affiliate indicated on the Website, the Legal Warranty must be enforced exclusively against the entity that acted as the seller of the defective product (whether it is the manager of the TEC Store Italia point of sale or another third-party Affiliate as identified and indicated on the sales receipt and/or purchase invoice). To avoid misunderstandings, it is specified that if the product was collected by the Customer at an Affiliate's point of sale, the latter is the sole entity obliged to offer the Legal Warranty, excluding TEC Store Italia, which is not considered the seller in this case.

Warranty and limitations of liability for Technical Assistance.

To protect Customers who request a repair intervention on smartphones or tablets from TEC Store Italia:
12 (twelve) month warranty for all LCD Display repair interventions;
6 (six) month warranty for all battery replacement interventions;
3 (three) month warranty for all Glass or Touch Glass repair interventions only;
45 (forty-five) day warranty for soldering interventions;
No Warranty (0 Days) for all repair interventions performed due to Liquid Contact with the device;
60 (sixty) day warranty for all Motherboard Repair interventions;
6 (six) month warranty for all repair interventions not specified in the categories listed above.
As per national and international laws in force, the Warranty DOES NOT cover: improper use, liquid contact damage, accidental damage, crushing, general damage. Any tampering, absence of seals, scratches, bumps and similar automatically invalidate the product warranty.

If a device malfunctions after a repair, it must be returned to a TEC Store Italia location. The device will be checked by our technicians and repaired if defective. Problems that do not concern the intervention performed by TEC Store Italia technicians, software problems, or problems due to any tampering are not covered by the warranty. 
To protect the Consumer, in case of purchases of goods/products or spare parts that are found to be defective or malfunctioning, TEC Store Italia guarantees a warranty of 1 (one) year from the delivery of the goods, which must be enforced within 2 (two) months from the discovery of the defect.
To protect the Professional/Entrepreneur who has purchased goods/products or spare parts that are found to be defective or malfunctioning, TEC Store Italia guarantees a warranty of 1 (one) year from the delivery of the goods, which must be enforced within 8 (eight) days from the discovery of the defect.
Tampered or incorrectly installed spare parts, without labels, damaged, with improper use, without boxes, will not be replaced. All used and sold products have Company reference codes. All repairs will be guaranteed by seals affixed by the center in relation to the work performed. Any returns of products under warranty must have unadulterated labels and seals, otherwise the warranty itself will be forfeited.
The Customer must, in order to enforce the warranty in their favor, keep proof of purchase (fiscal receipt or till receipt).
